Custody
Custody of your children is traditionally one of three types: sole, joint or split custody.
The type of custody has nothing to do with the amount of time that either
party has the children in their care. It
has everything to do with decision-making surrounding your children.
Notwithstanding that you and your spouse are separating, if there are
children, then you are going to have to interact and get along regarding the
children for quite a number of years to come.
More often, couples opt for co-parenting plans that encompass a joint
custody regime and encourage respect and a mutual spirit of co-operation
between the parents.
If court
occurs, the courts are mandated to make a decision that is based solely upon
what is in the best interests of the child or children.
This can involve investigations by social workers, psychologists, and/or
a lawyer being appointed to represent the children. The court process can be costly both emotionally and
financially.
